New AIA Contract Documents Available

To its full service distributors (AIA Dayton included), AIA National released 49 new, revised and/or renumbered documents and commentaries on October 18. The public launch is on schedule for November 5. Here are the major changes:

  • In the A201 and the O/A agreement for larger projects, the parties may opt to engage an Initial Decision Maker. This is a concept introduced by owner groups who were looking for an alternative to the architect representing them on matters of claims.
  • The documents now allow the Consolidation of Arbitrations; a concept lobbied for by owners and contractors.
  • Arbitration is now optional in both Owner/Contractor and Owner/Architect agreements; a provision that can expedite the claims resolution process for all.
  • A provision has been added which deletes the internal Statute of Limitations and allows state law to govern the beginning and conclusion of the Stature of Repose for claims.
